GOLFER INFORMATION

Here is what is on everyone's papers when you signed for your home, this is from:

Section 5 article 9

Easement for Golf Balls, Every Residential Unit and Residential Property and the Common Area and the Common Property of any Neighborhood are burdened with an easement permitting golf balls unintentionally to come upon the Common area, Units or Property immediately adjacent to the golf Course Property and for Golfers are reasonable times and in a reasonable manner to come upon the common Area, Common Area, Common Property of a Neighborhood, Residential Property, or the exterior portions of a Residential Unit to retrieve errant golf balls; provided however, if any Residential Unit is fenced or walled, the golfer will seek the Owners permission before entry. By acquiring any portion of the Property, each Owner acknowledges and assumes the risk that errant golf balls may come upon such Property, and waives any action or cause of action arising from errant golf balls against Declarant, the Association, a Neighborhood Association/Committee and the owner or operator of the Golf Course Property. The existence of this easement shall not relieve golfers of liability for damage caused by errant golf balls.

 

First of all don’t try and sue the H.O.A. or the golf course. When you bought your home, you signed off the responsibility of their involvement of a golf ball going through your window.

It is the responsibility of the golfer.

The best thing to do is TAKE A PICTURE. It is the only way you can prosecute, if you want to have the golfer pay for your window. Don’t waste time arguing over your window with the golfer, just go inside and get your camera/or cell phone and get a picture of the Golfer and more important the golf cart Number!  This way he has to go back to the club house and turn it in, that’s when you get him. You call your non emergency phone number and call the clubhouse, then report the person and golf cart number. Wait for that person at the clubhouse and have the police meet you there. If you want to press charges, this is the only way to do it….. (This also goes for someone who is relieving themselves in plain view) If you want to press charges, this is the only way!

WHAT IF A GOLFER IS ON MY PROPERTY

A golfer can retrieve the ball and come back, but he cannot look for his ball, and especially going through your bushes - looking for his ball. If his ball is visible he can take a few steps and take it, then get off of your property.  (and for Golfers are reasonable times and in a reasonable manner to come upon the common Area, Common Area, Common Property of a Neighborhood, Residential Property, or the exterior portions of a Residential Unit to retrieve errant golf balls;)

A golfer CAN NOT HIT THE BALL OFF OF YOUR PROPERTY!  This happens too often, where a golfer doesn’t want to lose a stroke.

I’m sorry sir but you’re on my property!” But I’ll lose a stroke” You’re going to lose more than that if you hit that ball…. You don’t need to be rude right away, but it is your property, and no one should hit the ball and leave a “divot” on your lawn.

Don’t forget to call your local law enforcement. Just FYI, the entire Golf Course is in Osceola County, No matter if you live in Kissimmee, the Golf Course is in Osceola County.

I paid over $500.00 in replacing windows!!  Who’s going to pay me back!!

The only way to have someone pay for your broken window is to read the article above again. But it’s obvious what to do, take it into your own hands to prevent this from happening again.  No one is going to do this for you, or you just haven’t thought of it yet. Instead of paying all that money on replacing windows, (And you probably will replace more if you don’t think of a problem solver) Is to either put a tall bush or tree in front of that window or try a Plexiglas window. There is a special window that is on the market especially made to prevent golf ball damage. You have to look it up on the internet or call a window place.

Then there is Hurricane screens at; http://www.youtube.com/watch?v=1AISL5SKeFo   these guys mention how Golf Balls just bounce off the screen. I mean with a little searching on the internet you can find what you’re looking for. I found this information in two minutes. Go to YouTube and put in Golf ball proof window protection.

Instead of complaining about the golf balls coming through your windows,  it’s your home, take care of the problem.

When you bought your home, you signed wavers about a broken window made by a golf ball, so you should do something about making your home enjoyable, not upsetting.
